DUMPSTER RENTAL AGREEMENT
Happy BLU Dumpsters
By ordering, scheduling, or accepting delivery of a dumpster from Happy BLU Dumpsters
(“Contractor”), the customer (“Customer”) agrees to the following Terms & Conditions:
1. RENTAL PERIOD
The rental period, included days, weight allowance, and applicable fees are specified on the
Customer’s invoice, which is incorporated into this Agreement.
– Additional rental days will be charged at the published per-day rate listed on the invoice
– Contractor reserves the right to remove the dumpster upon expiration of the rental period
2. ACCEPTABLE MATERIALS
Dumpsters may only be used for:
– Household debris
– Construction and demolition materials
– Remodeling materials
– Furniture
– Yard waste
– Other non-hazardous materials
3. PROHIBITED MATERIALS
The following items are strictly prohibited unless explicitly approved in writing:
– Paints, solvents, stains, chemicals
– Oils, fuels, antifreeze, automotive fluids
– Asbestos or asbestos-containing materials
– Hazardous or toxic waste
– Batteries
– Propane tanks or pressurized containers
– Tires
– Refrigerators, AC units, or appliances containing refrigerants
– Medical waste, biohazards, or infectious materials
– Explosives, firearms, ammunition, fireworks
– Liquid waste, wet concrete, sludge
Customer is fully responsible for all costs resulting from prohibited materials, including but not
limited to:
– Disposal charges
– Cleanup costs
– Regulatory fines
– Environmental penalties
4. WEIGHT LIMITS & OVERAGES
Each rental includes a specified weight allowance as listed on the invoice.
– Any weight exceeding the allowance will be charged at the published overage rate per ton
– Customer agrees to pay all overweight fees without dispute
5. LOADING REQUIREMENTS
Customer agrees that:
– Materials will not exceed the top rails of the dumpster
– No debris will extend beyond container boundaries
– Dumpster doors must remain operable and secured
– Dumpster will not be moved, altered, or tampered with
Overloaded or unsafe dumpsters will not be serviced until corrected and may incur additional trip
charges.
6. ACCESS & SERVICE CONDITIONS
Customer must provide clear, safe access for delivery and pickup.
Additional fees apply if:
– Dumpster is blocked or inaccessible
– Vehicles obstruct access
– Gates are locked
– Site conditions are unsafe (mud, snow, ice, grade issues)
– Customer requests a return trip
7. DRY RUN FEE
A $150 Dry Run Fee will be charged if delivery or pickup cannot be completed due to:
– Blocked or inaccessible dumpster
– Overfilled container
– Unsafe conditions
– Customer absence (when required)
– Same-day cancellation or reschedule
8. CANCELLATIONS
– Orders canceled before dispatch receive a full refund
– Orders canceled after dispatch or on the scheduled service date WILL incur a $150 Dry Run Fee
9. PROPERTY DAMAGE DISCLAIMER
Customer acknowledges that dumpsters and trucks are heavy equipment.
Contractor is not responsible for damage to:
– Driveways, pavement, asphalt, or concrete
– Landscaping or lawns
– Underground utilities, irrigation, or septic systems
Exception: Contractor is liable only for damage caused by gross negligence or intentional
misconduct.
Customer assumes all risk associated with placement location.
10. LOSS, THEFT, OR DAMAGE TO EQUIPMENT
Customer is fully responsible for the dumpster while in their possession, including:
– Theft
– Fire damage
– Vandalism
– Misuse
Customer agrees to pay full repair or replacement costs if damage occurs.
11. PERMITS & COMPLIANCE
Customer is responsible for obtaining all required permits, including:
– HOA approvals
– Municipal or city permits
– Street placement authorization
Customer assumes all fines or penalties for non-compliance.
12. PAYMENT TERMS
– Payment is due as stated on the invoice
– Customer agrees to pay all applicable:
o Overage fees
o Extra day charges
o Trip charges
o Dry run fees
Unpaid balances may result in:
– Late fees
– Collection costs
– Attorney fees
– Interest at the maximum rate allowed by law
13. RIGHT TO TERMINATE SERVICE
Contractor reserves the right to:
– Remove the dumpster without refund
– Terminate service immediately
If Customer:
– Violates this Agreement
– Loads prohibited materials
– Creates unsafe conditions
14. LIABILITY & INDEMNIFICATION
Customer assumes full responsibility for use of the dumpster and agrees to:
Indemnify, defend, and hold harmless Contractor from any claims, damages, losses, fines, or
liabilities arising from:
– Customer’s use of the dumpster
– Improper loading or overloading
– Prohibited materials
– Injury to persons or property
15. LIMITATION OF LIABILITY
Contractor’s total liability is strictly limited to the amount paid for the rental.
Under no circumstances shall Contractor be liable for:
– Indirect damages
– Incidental damages
– Consequential damages
– Lost profits or business interruption
16. GOVERNING LAW
This Agreement shall be governed by the laws of the state in which the service is performed,
unless otherwise required by law.
17. AGREEMENT ACCEPTANCE
Customer acknowledges and agrees to these Terms & Conditions by:
– Signing this Agreement
– Accepting delivery
– Scheduling service
– Submitting payment
This Agreement constitutes a binding legal contract.
